These terms apply to everyone who uses gallery.artome.com — whether you are buying a framed print, running a gallery for a school or district, or selling your own work.

Who this covers

These terms govern your use of gallery.artome.com and the services offered through it. They apply to three groups, and some sections below apply to only one:

  • Buyers — families and community members who purchase framed prints.
  • Schools and districts — staff who upload artwork, run a gallery, and receive earnings.
  • Individual artists — people selling their own work through their own gallery.

What Artomé does

We turn artwork into professionally framed prints and sell them through an online gallery. We print, frame, pack and ship every order. Schools, districts and artists do not handle fulfilment, inventory or shipping.

Use of the gallery platform is provided at no charge. If we introduce optional paid capabilities in future, anything you already have will not begin to carry a cost without advance notice.

Accounts and access

You are responsible for the accuracy of the information in your account and for activity that happens under it. Access to a school or district is granted by us or by an existing lead for that organisation, and is scoped to that organisation alone.

Individual artist accounts require you to be 13 or older. We do not knowingly create accounts for children under 13.

We may suspend or remove access for misuse, for breach of these terms, or at the request of the school or district that controls the account.

Student artwork and permission

This section applies to schools and districts, and it is the one that matters most.

Student artwork cannot be offered for sale, and a student name cannot be printed on an artwork label, until a guardian permission record exists or the organisation has recorded a release covering the work. This is enforced by the platform, not left to practice.

The school or district remains responsible for obtaining and holding valid permission, for telling us promptly if permission is absent, refused or withdrawn, and for the accuracy of the student information it enters. On notice that permission is absent or withdrawn, we remove the affected artwork from sale.

Students keep ownership of their original artwork. Uploading artwork grants Artomé only the licence needed to reproduce, display and sell prints of it through the gallery, and to remove it when asked.

Pricing, orders and payment

Artomé sets a fixed base price for each print, covering production, framing and shipping. Schools, districts and artists set a markup on top, and that markup is their earnings. Prices, sizes and available products may change; the price shown at checkout is the price that applies to that order.

Payment is taken by Stripe through its own hosted checkout. Card details are entered directly into Stripe and are never transmitted to or stored by Artomé.

We may decline or cancel an order — including after it is placed — where there is a pricing or description error, a suspected fraudulent transaction, or where the artwork cannot lawfully be sold. If we cancel an order that has been paid, we refund it.

Earnings and payouts

Earnings accrue on the markup portion of each completed sale. We hold payouts until a payout destination is on file for the receiving organisation, and we may withhold or reverse earnings on orders that are refunded, charged back or cancelled.

Earnings shown in the platform reflect the price and revenue model recorded at the time of each sale. Later changes to a markup do not re-price past orders.

Returns and damaged goods

Prints are made to order. If an item arrives damaged or defective, or is not what was ordered, contact us and we will replace or refund it. Because each print is produced individually, we do not accept returns for change of mind.

Acceptable use

You agree not to:

  • upload artwork you do not have the right to reproduce, or that infringes anyone else’s rights;
  • upload unlawful, harassing, obscene or deliberately harmful content;
  • attempt to reach another organisation’s data, or to probe, scan or interfere with the platform’s security;
  • use the platform to collect personal information about others, or to send unsolicited messages;
  • resell or redistribute the service itself.

Intellectual property

The platform, its software and its branding belong to Artomé. Artwork belongs to the student or artist who made it. Nothing here transfers ownership of artwork to Artomé beyond the licence described above.

If you believe material on the platform infringes your rights, write to info@artome.com with enough detail to identify the work, and we will investigate and remove it where appropriate.

Availability and disclaimers

We work to keep the platform available and correct, but we do not warrant that it will be uninterrupted or error-free, or that every description, image or colour rendering is exact. Screens vary, and printed colour may differ slightly from what you see.

Except where the law does not permit their exclusion, the service is provided “as is” without implied warranties of merchantability or fitness for a particular purpose.

Limitation of liability

To the extent permitted by law, Artomé is not liable for indirect, incidental, special or consequential loss, including lost revenue or lost data. Our total liability arising from the service is limited to the amounts paid or payable in connection with the order or earnings period giving rise to the claim.

Nothing in these terms limits liability that cannot lawfully be limited.

Changes and termination

We may update these terms. Where a change is material we will give notice in the platform, and continued use after that constitutes acceptance. The effective date shown above always reflects the current version.

You may stop using the service at any time. A school or district may end its participation and ask us to remove its artwork and student information. Obligations already incurred, including for orders already placed, survive.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Where a school or district has signed a separate written agreement with Artomé, that agreement controls to the extent it conflicts with these terms.
